Model WHS Act cross-comparison table

The model WHS laws have been implemented in the Australian Capital Territory, New South Wales, the Northern Territory, Queensland, South Australia, Tasmania, the Commonwealth and Western Australia. While these jurisdictions have adopted the model WHS Act, they may have variations in their respective WHS Acts compared with the model WHS Act. For example,  variations in a jurisdictions’ WHS Act may be necessary to make sure the legislation is consistent with their relevant drafting protocols and other laws and processes.

The model WHS Act cross-comparison table summarises the similarities and differences between the model WHS Act and the WHS Acts of the jurisdictions that have adopted the model WHS Act. 

Please note that Safe Work Australia makes no representation about the accuracy, reliability, currency or completeness of the table. Safe Work Australia does not regularly review or update the information in the model WHS Act cross-comparison table and the information is not a complete and up-to-date summary of amendments to the model WHS Act or the jurisdictions’ implementation of the amendments.  

The table was last amended on 16 February 2024.
