Commonwealth

There are limited transitional arrangements for the engineered stone prohibition for persons conducting a business or undertaking (PCBUs) covered by the Commonwealth work health and safety laws. These arrangements ‘mirror’ individual state and territory transitional arrangements and apply depending on the jurisdiction where work is physically performed. For example, for PCBUs operating in a jurisdiction which permits work in relation to contracts entered into before 31 December 2023, the Commonwealth will similarly permit the work to be completed up to 31 December 2024.

New South Wales

In NSW, there will be a transition period for engineered stone contracts that have been entered into before 31 December 2023 and include installation prior to 31 December 2024.

Queensland

Queensland will not have a transitional period for the ban.

This means that after 1 July 2024, work with engineered stone in the manufacturing, supply, processing, and installation of benchtops, panels and slabs must cease even if contracts were entered into prior to the ban date.

South Australia

SA will be implementing transitional arrangements between 1 July 2024 and 31 December 2024.  

In South Australia there will be a transitional period for contracts for the installation of engineered stone benchtops, panels and slabs entered into or before 31 December 2023. These contracts will be exempt from the ban provided installation is completed by 31 December 2024.

Victoria will not have a transitional period for the ban.

This means that after 1 July 2024, you cannot work with engineered stone benchtops, panels or slabs in Victoria, even if you entered into a contract before that date. Repairs, minor modifications, removal and disposal of engineered stone benchtops, panels or slabs (legacy stone) installed prior to the ban will be permitted. This work will be subject to existing control requirements for engineered stone.

Australian Capital Territory

The ACT will not have a transitional period for the ban.

This means that after 1 July 2024, work with engineered stone in the manufacturing, supply, processing, and installation of benchtops, panels and slabs must cease even if contracts were entered into prior to the ban date.

Western Australia

Western Australia will provide a transition period of 6 months after the 1 July ban on the supply, installation or processing of engineered stone slabs, panels and benchtops in Western Australia.

Under the transition period, work of this nature carried out between 1 July 2024 and 31 December 2024 will be exempt from the prohibition, provided the work falls under a contract entered into on or before 31 December 2023.

Northern Territory

The Northern Territory is implementing a six month transitional period to allow for contracts entered into before 31 December 2023 to be completed.

In this period any work during the manufacturing, supply, processing, and installation of engineered stone benchtops, panels and slabs must be controlled, and these works must be completed by 31 December 2024.

Tasmania will be adopting a six-month transition period for contracts entered into before 31 December 2023.

During the transition period, work involving the manufacture, supply or processing of the engineered stone products will not be prohibited as long as the contract for the work was entered into before 31 December 2023 and the work is finished by 31 December 2024.

After 31 December 2024, the prohibition will take full force and no work can be undertaken on the manufacture, supply or processing of engineered stone benchtops, panels or slabs.
