Workers’ compensation (Dust Diseases) Act 1942 |

This Act makes provisions regarding the payment of compensation in the case of workers who suffer death or disablement owing to a dust disease specified in Schedule 1 of the Act, including any pathological condition of the lungs, pleura or peritoneum that is caused by dust that may also cause a disease so specified, to validate certain payments. |
Any worker who has developed a ‘dust disease’ as defined in Schedule 1 of the Act from occupational exposure to dust as a worker in New South Wales. |
As at 30 June 2017 compensation benefits are being provided to over 4,609 clients: 1,405 workers and 3,204 dependants of deceased workers. |
A system of no fault compensation for workers and their dependants where a worker suffers death or disability from dust diseases. |
Coal Industry Act 2001 |
To operate an innovative, efficient, effective, competitive and fully funded workers’ compensation insurance scheme for the coal mining industry in NSW. |
Coal Mines Insurance Pty Ltd (CMI) is a specialised insurer and it is the insurer of all Employers in the NSW coal mining industry under the Coal Industry Act 2001. |
As at 30 June 2018, 693 policy holders covering 25,161 employees in NSW. |
The Joint Coal Board (JCB) was dissolved by enactment of the Coal Industry Repeal Act 2001 (Cth). The JCB was dissolved on the 1st January 2002. The assets, rights and liabilities of the JCB have been transferred to an approved company, namely to the Coal Services Pty Ltd (ACN 099 078 234). This transfer took effect on and from the 1st January 2002. CMI is a wholly owned subsidiary of Coal Services Pty Ltd. Coal Services P/L is owned 50% by NSW Minerals Subsidiary Company P/L and 50% by the Construction Forestry Mining and Energy Union. NSW Minerals Subsidiary Company P/L is a company owned by the NSW Minerals Council, an association representing employers in the NSW coal industry. Coal Services P/L and CMI operate as private companies, subject to the Federal Corporations Act 2001, but are also created by statute (the Coal Industry Act 2001). |

Treasury Managed Fund (TMF) (NSW Government’s self-insurance scheme) |
